Kako‘o Maui, Housing Program – Online Privacy Policy

Introduction 

The Council for Native Hawaiian Advancement ("CNHA" or "We") respects your privacy and is committed to protecting any of your personal information that may come into our custody as we carry out our mission to provide disaster aid and relief to those impacted by the August 2023 Maui Wildfires.  As part of this commitment, we have adopted this Online Privacy Policy (“Policy”), which explains our practices for collecting, using, maintaining, protecting, and disclosing information that we may obtain when you visit to or use of the Kako‘o Maui, Housing Program (“Program”) website, www.kakoomaui.com (the "Website"). 

Please read this Policy carefully. If you disagree with anything in this Policy, your sole remedy is to refrain from use our Website. By accessing or using this Website, you agree to this Policy and consent to our collection, use, and/or disclosure of your information in accordance with these terms. We may make changes to this Policy at any time, which will be posted here. In the event changes are made to the Policy, your continued use of the Website will be deemed to be acceptance of any changed terms.  It is your responsibility to stay informed of any changes, so please check this page periodically to stay informed of any updates or changes to the Policy.   

 

Information Covered by This Policy 

This Policy applies to any information: (1) you submit through the Website, (2) your browser automatically shares when accessing the Website, (3) you provide when corresponding with CNHA about the Program or the Website (such as via email, text, etc.), or (4) obtained by CNHA for purposes directly related to reviewing your application or providing you with assistance through the Program (except for information provided to CNHA under a contract with a third-party). 

The Policy does not apply to information: (1) CNHA obtains offline or through any other means aside from those listed above (such as, information collected websites operated by our affiliates, partners, or any other third-party; or (2) Collected by any third-party (including any of our affiliates or partner organizations), including through any external application, website, or content (including advertising) that may link to or be accessible from or through the Website. 

 

The Information Collect 

Information You Provide Directly to CNHA  

If you are a wildfire survivor or property owner using the Website to apply for participation in the Program, we will ask you to submit information about yourself, members of your household, and/or your property (“Applicant Information”) as part of the Program’s online application process. You and CNHA may also exchange additional communications concerning or containing additional Applicant Information required from you to complete your application. We collect your Applicant Information to assess whether you qualify for Program, to provide disaster relief assistance through the Program. 

You may directly provide Applicant Information to CNHA by: (1) Submitting your application or other forms through the Website; (2) Corresponding with CNHA by email, text message, etc., about the Program; (3) Completing any survey(s) we may provide to assist with our research.  
Examples information we ask or require you to provide include: 

  • Information about yourself and members of your household (such as: names, social security numbers, birth dates, mailing or rental property addresses, other contact information, etc. 

  • Information about whether you qualify for the Program and your level of need (such as: employment status, employer name and contact information, income amounts and sources, tax records, etc., and applications or records regarding aid from other disaster relief organizations including FEMA or American Red Cross). 

  • Your demographic information (such as: age, ethnicity, gender, military service, etc.) 

 

Information Automatically Shared from Your Web Browser 

When you access or use the Website, your device shares information with CNHA (“Browser Information”).  We may collect any of this Browser Information to 

  • Provide you with a more streamlined and convenient user experience by saving your information from prior visits,  

  • Improve our Website based on general browsing patterns, and 

  • Generating statistical data for evaluating our ability to provide community support and charitable services.  

Browser Information concerns the device and network you are using (such as your IP address, operating system, and browser type), as well your browsing activity (such as your activities on the Website and the dates and times you access the Website).   

 

Additional Ways We Use Information  

In addition to the uses specified elsewhere in this Policy, We may use collected information to: 

  • To implement the Program and provide related information, relief, and/or services; 

  • To update you about your application or account, or other Program-related changes; 

  • To contact you about other programs by CNHA or partners that you may qualify for; 

  • To perform any obligations or enforce any rights under any of our contracts; or, 

  • For any other purpose(s) which you have consented to. 

Data Security 

CNHA is committed to maintaining the highest reasonable level of applicable cyber and organizational measures to protect your PII in its custody from accidental loss and from unauthorized access, use, alteration, and disclosure.  To this end, CNHA has adopted policies and best practices for information and cyber security which have been adapted from the National Institute of Standards and Technology (NIST) Special Publication 800-531 and International Organization for Standards (ISO) 270012, among other sources.   

The safety and security of your information also depends on you. Where We have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Website like message boards. The information you share in public areas may be viewed by any user of the Website. 

Unfortunately, the transmission of information via the internet is not completely secure. Although We do our best to protect your personal information, We cannot guarantee the security of your personal information transmitted to our Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website. 

 

Disclosure of Information 

CNHA is committed to preserving your privacy and protecting your information, nevertheless, there may be instances where We disclose certain information covered by this Policy to third-parties, such as our partners, program funders, or governmental bodies.   

To protect your privacy, We have adopted the following policies and practices, which ensure that your information has protections appropriate for the information’s type and sensitivity. 

 

Personal Information 

Information subject to this Policy that may be used to identify a specific individual (“Personal Information”), such as your Applicant Information, tax or employment records, IP address, or individual browsing activity, is highly sensitive and will only be disclosed in limited circumstances, for limited purposes, and for specific uses. 

In general, We will only disclose your Personal Information for the purpose of: providing you with Program assistance; complying with the law or court order; to fulfill our obligations (such as reporting requirements) or enforce our rights under any contract We have with you, any of our partners, or affiliates of the Program.  We may also, however, share your Personal Information whenever we have your consent to do so, or where CNHA reasonably determines, in its sole discretion, that it's in your best interest or for the overall benefit of Kako‘o Maui Housing Program aid recipients, and that there is no reasonably viable alternative. 

*Personal Information of Children Under 18: CNHA does not intentionally gather Personal Information concerning children under 18, except that which is necessary to verify that you have properly listed them as a member of your household in your application.  CNHA will only use such information for this purpose and We will only disclose this information to complete its verification or where required by law or by court order. 

All Other Information 

Aside from Personal Information, all other information subject to this Policy (including aggregated Personal Information that cannot be used to identify any individual) may, where the law allows, be shared at CNHA’s discretion.
